Why SC is asking government if EC independence is just for show

The Supreme Court has put the Modi government’s 2023 law on appointing election commissioners under sharp scrutiny. It has also questioned whether a selection panel dominated by the executive can inspire public confidence in the Election Commission’s neutrality.
The bench’s “show of independence” remark is poignant because under the current law, the Prime Minister and a Cabinet minister nominated by him sit on the three-member selection panel along with the Leader of Opposition, creating what petitioners say is a built-in 2:1 executive majority.
